Plush Folly eLearning Programme and Modules - Terms & Conditions

1. Definitions
(i) "eLearning Programme" shall mean the course identified and all related Materials, support and tuition where applicable.  eLearning materials are in the form of digital downloads.
(ii) "Modules" shall mean the module identified and all related materials, support and tuition where applicable.  Modules are considered to be digital downloads.
(iii) "Materials" shall mean the learning materials for the eLearning Programme or any part of them.
(iv) "Ingredients" shall mean the raw ingredients needed to create the products specified on the eLearning Programme.
(v) Your "Support Period" depends on the length of time you choose to study and will be between one and twelve months unless otherwise stated in your course materials.
(v) Singular words shall include the plural and vice versa.


2. Payments and Cancellation
(i) We agree to sell and you agree to buy the eLearning Programme or Modules on the terms set out herein.
(ii) You will use up-to-date technology to access the Materials in the form of a PC running Windows v7 or later or an Apple Mac, tablets or smartphones or other technology that can read PDF documents.
(iii) We have taken every step to ensure our site is free from viruses. However, we cannot always guarantee this. You are responsible for installing adequate and up-to-date virus-checking software on your computer.
(iv) Under no circumstances shall we be deemed to have received payment until payment has actually been received by us in full.
(v) In line with the Consumer Rights Act 2015 a digital download is classed as data which is produced and supplied in digital form for example the eLearning files.  If you want to access your digital files within 14 days of purchase, you will have to give your consent to waive the 14 day cooling-off period by agreeing to our terms and conditions.  If you don't give your consent, the 14 day cooling-off period still applies but you won't be able to download your digital files until the 14 day period has ended.  This is to prevent you from changing your mind after you have access to the digital content.
(vi) By agreeing to these terms and conditions you waive your right to a 14 day cooling-off period but we may at our discretion refund you 50% of the course fee if the reasons for cancelling are exceptional and beyond your control.
(vii) We agree to make the full-Module eLearning Programme available to you for 12 months from date of purchase and the individual Modules available to you for either three or six months from date of purchase.
(viii) After three or six months the support period is terminated and your student files will be removed from the Plush Folly website. We advise you to make a local copy when you start the programme if you wish to keep a copy for longer than the support period.  
(ix) If you cannot locate your files after the course period ends you may request the files to be sent to you provided you purchased the course(s) within the last four years.  Fees apply. 
(x) If you wish to extend your support period and continue your studies this can be arranged provided you are within three months of the original expiry date of your eLearning course support period.  Fees apply.   


3. Care of the Materials and Ingredients
(i) The Materials are made available to you electronically. Paper copies are available at an additional cost.
(ii) If for any reason, the Materials will not load on to your selected technology, you must notify us within 24 hours of receiving access to the Materials and provide us with full evidence of the error encountered.  
(iii) We will release all the Materials to you to enable you to work systematically through them.
(iv) You will inspect each set of Materials promptly following access via our online courseware section. You will tell us about any omission as soon as it is reasonably possible.
(v) Under no circumstances may you copy the Materials, reuse the Materials, or modify the Materials nor pass the Materials on to others for their use.
(vi) Under no circumstances may you sell on the Materials to a third party.
(vii) If applicable, any Ingredients that are provided as part of the eLearning Programme will be dispatched to you once full payment has been received. You will be notified when they have been dispatched.
(viii) If you wish to substitute any of the ingredients we provide you for your recipes you may to swap like for like. If you are uncertain, you must contact your tutor by email to ask if the proposed swap is acceptable.
(ix) Plush Folly take no responsibility for the products made as part of your eLearning Programme regardless of whether Plush Folly have provided the ingredients or not.
(x) Plush Folly cannot take responsibility for full knowledge and advice on individual ingredients used outside of the scope of the eLearning programme.
(xi) We always advise a patch test on any of the products you make as part of the eLearning Programme Modules before first use.


4. Homework
(i) The Materials contain information, tests and/or assignments. Your tutor will mark assignments that are returned to Plush Folly and give you feedback.
(ii) It is your responsibility to ensure that your homework is returned clearly marked with your name and within the designated support period.
(iii) The online tests are self-marking and you will receive your results online after submitting the test.


5. Services
(i) During the eLearning Programme and Module Support Period, we will provide you with support and tuition as set out in the course description.
(ii) We may at our sole discretion extend the Support Period for an agreed fee, if requested.


6. Warranties and Limitation of Liability
(i) We warrant that the Materials will be of satisfactory quality but do not warrant that the Materials will be error free.
(ii) We warrant that we will perform any services provided hereunder with reasonable skill and care.
(iii) The recipes you are required to follow on the course are designed for you to make cosmetic products for personal use. These products may not be sold. Our aim is to highlight the information and essential steps you will need to take in order to create your cosmetic products and cannot be held responsible for any adverse reaction or undesired result you may experience in making and using these products both during the product manufacture or afterwards.
(iv) We will not be held responsible for differing advice you may be given by any third party interpreting cosmetic production in their own way.


7. Other Terms
(i) No relaxation or indulgence which we may extend to you shall affect our rights under these Terms and Conditions.
(ii) You will notify us immediately in writing of any change in the postal address you have specified.
(iii) You will be notified via the Plush Folly website in advance of any holidays or other absences (longer than two weeks) that may be taken by the assigned instructor.
